As attorneys, should we worry about our client’s child suing us for not
squeezing every dollar out of the estate? Or should we be more concerned
with the well-being of our client? What about the client’s brother that
may sue us because he went into the Medicaid nursing home and found our
client was consistently isolated, left in soiled briefs and sharing a
room with a guy that cries for his wife every evening from 8 to 10 pm?
Whether the client’s brother raises the issue with the daughter or not,
what are the odds the daughter will ever consider placing him in a
private pay environment—especially if she has fallen into some difficult
financial times?
The Medicaid planner should know what is going on in long term care,
specifically in regard to her own community. So get in the right box!
Educate yourself,and you will be more comfortable and confident
counseling your potential Medicaid clients. And they will thank you.
